Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our express written permission. You may not modify, distribute, or repost anything on this website for any purpose without the expressed written permission of an officer of the Company.

Accuracy of Content

We have taken every care in the preparation of the content of this website, particularly to ensure that prices quoted are correct at the time of publishing and that all services have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or services, or their prices as advertised on this website.

All prices are displayed exclusive of VAT which will be added at the standard Kenyan VAT rate. If the price of the goods increases between the date we accept your order and the delivery date, we will notify you and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable, you will have the right to cancel your order.

To the extent permitted by applicable Kenyan law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. We shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained on this website.

Damage to Your Computer

We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer equipment. It is your responsibility to ensure you have the right equipment and security software to use this website. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Payment and Service Delivery

We will charge your credit account for payment upon receipt of your order unless delivery of our service cannot be fulfilled within 30 days. We accept no liability if a service is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the service, we can cancel the contract and/or suspend any further deliveries or services to you. This does not affect any other rights we may have.

Unless otherwise stated in a booking confirmation, our payment terms are strictly 30 days from the date of invoice.

Delivery of Physical Goods (If Applicable):
Please note that we are only able to deliver to addresses within the Republic of Kenya. We will deliver goods to the address you specify in your order. We cannot accept any liability for any loss or damage to goods once they have been delivered in accordance with your instructions. We will aim to deliver goods by the date quoted, but delivery times are not guaranteed.

Risk and Ownership

Risk of damage to or loss of the goods/services passes to you at the time of delivery, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods/service once we have received cleared payment in full. Goods supplied are not for resale.

Acknowledgement and Acceptance of Your Order
You will need to provide us with your e-mail address, and we will notify you by e-mail as soon as possible to confirm receipt of your order and e-mail you again to confirm details. Acceptance of your order will take place upon the formal dispatch/commencement of the ordered service(s).

Cancellation Rights

The right to cancel a contract for service or goods is subject to and governed by the Consumer Protection Act, 2012 (Kenya), and any subsequent relevant legislation. Customers have the right to cancel an order as stipulated by these laws and any specific terms agreed upon for that service.

Exclusion of Liability

Any disclaimers and exclusions of liability in these Terms shall not apply to any damages arising from death or personal injury caused by our negligence. If any provision of these disclaimers and exclusions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Law, Jurisdiction, and Language

This website, any content contained therein, and any contract brought into being as a result of usage of this website are governed by and construed in accordance with the laws of The Republic of Kenya. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of Kenya. All contracts are concluded in English.
